Privacy policy

I. General provisions

1. This Privacy Policy sets out the rules of processing and protecting personal data of Customers using the online store available at www.sklep.hodowca.agro.pl (hereinafter referred to as the ‘Store’) and constitutes the fulfilment of the information obligation of the Controller in accordance with art. 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing the Directive 95/46/EC (general regulation on personal data protection) (hereinafter referred to as the ‘GDPR’).

II. Personal data controller

1. The controller of your personal data (hereinafter: personal data) is ‘HODOWCA’ Sp. z o. o. with its registered seat in Straszyn, Poland with the following contact details: correspondence address: ul. III. Principles of personal data processing  

1. Hodowca processes your personal data in accordance with the provisions of the GDPR.
    

2. Hodowca uses technical and organizational measures required by the provisions of EU law to ensure the protection of personal data processing and protection of personal data against unauthorized disclosure, takeover by unauthorized persons, processing in violation of the provisions as well as their alteration, loss or destruction.

IV. Necessity/voluntariness of providing personal data 

1. Providing the data marked in the Store as required is voluntary, but necessary to use the functionality of the Store, including for setting up and maintaining a Customer Account in the Store, placing and processing an order and making its initial valuation. If you do not provide the required data, we may refuse to process the order, or to make a preliminary valuation, or to set up and maintain your Customer Account in the Store. 

2. To the extent that the consent to the processing of your personal data has been expressed by you only for marketing purposes, providing your personal data is voluntary, but the refusal to give your consent or its withdrawal will prevent Hodowca from informing you about its new offers and promotions.

V. Purposes and grounds for processing personal data

1. Your personal data will be processed on the basis of art. 6 sec. 1 lit. a) -c) and f) of the GDPR for the following purposes: 

• concluding and implementing a contract for the sale of goods or providing services (placing and processing orders, making an initial valuation);

• maintaining a Customer Account in the Store;

• replying to a message sent via the Contact Form; 

• contacting you in order to execute your order or making a preliminary valuation, by means of distance communication (e-mail, post office, telephone);

• implementing the process of complaint or withdrawal from the contract;

• archival (evidence) purpose in the event of a legal necessity to prove facts, in order to pursue any legitimate interests of Hodowca;

• possible determining, investigating or defending against claims being the exercise of the legitimate interest of Hodowca;

• making financial settlements, in particular issuing accounting proofs;

• performing legal obligations of Hodowca;

• direct marketing of own services and goods, which is the legitimate interest of the Breeder;

• sending the newsletter to your e-mail address based on your consent;

• detecting and preventing fraud.

VI. Categories of your data that we process

1. Hodowca processes the following categories of personal data: basic identification data (name, surname), company name; tax identification number, address data, telephone number, e-mail address.§6. Recipients of personal data.

2. We may make your personal data available to the following entities: payment system operators; accounting offices; law firms; IT companies; hosting services providers; entities providing postal and courier services.

VII. Transferring data to third countries or international organizations

1. We do not transfer your personal data outside the European Union.

VIII. Period of personal data storage.

1. Your data will be stored for the duration of the contract (order, initial valuation), and after its completion, until the expiry of the limitation period for claims under the contract concluded by you.

2. Your personal data recorded in the accounting documentation will be kept for the period specified in applicable regulations, including tax regulations.

3. Your personal data are also stored by Hodowca for marketing purposes until you object to their processing for this purpose or withdraw your consent if we have processed them on the basis of the consent, or we ourselves determine that they have become obsolete.

IX. Your rights

1. You have the right to access your data and the right to request rectification, erasure and restriction of the processing.

2. To the extent that the basis for the processing of personal data is the premise of the legitimate interest of the controller, you have the right to object to the processing of your personal data, including the right to file a  ‘marketing objection’ as to data processing for the purpose of direct marketing. If you use the "marketing objection" right, we will stop processing your personal data for this purpose.

3. To the extent that the basis for the processing of your personal data is your consent, you have the right to withdraw the consent. Withdrawal of the consent does not affect the lawfulness of the processing which was carried out on the basis of the consent before its withdrawal. 

4. To the extent that your data are processed in order to conclude and perform the contract (order execution, initial valuation), or processed on the basis of your consent, you also have the right to transfer your personal data, i.e. to receive the personal data from Hodowca, in a structured, commonly used, machine-readable format. You can transfer the data to another data controller. The right to transfer data does not apply to data that are company secrets.

5. You have the right to access your data and the right to rectify them, as well as to limit their processing, i.e. to demand that Hodowca limit the processing of your personal data only to their storage or performing actions agreed with you. 

6. You also have the right to lodge a complaint with the supervisory body dealing with the protection of personal data. 

7. In order to exercise your rights or lodge a complaint, send a request to the following e-mail address: hodowca@qv.pl, call the number 58 682 68 56 or do it at the registered office of Hodowca.

8. If you believe that we are processing your personal data unlawfully, you can also lodge a complaint with the President of the Personal Data Protection Office.

§10. Information on automated decision making, including profiling

1. At the same time, we would like to inform you that currently your data are not be processed automatically, including in the form of profiling.

2. You may be subject to a decision based only on the automated processing of personal data, including profiling, if we are entitled to do so by an applicable legal provision, or if you have previously consented to it.
